Terms of Use
1. Acceptance of Agreement
These Terms of Use (the "Terms") govern your access to and use of the websites, pages, online forms, and digital services operated by The Corporation of the City of Cambridge (the "City") (collectively, the "Website"). By accessing or using the Website, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you must not use the Website. The City may amend the Terms from time to time without specific advance notice. The latest version will be posted on the Website and will apply when posted.
2. Copyright and Ownership
All materials displayed or otherwise accessible through the Website, including without limitation text, logos, graphics, photographs, images, illustrations, audio and video, designs, page headers, software, and compilations (collectively, the "Content"), are protected under applicable Canadian and foreign copyright, trademark, and other intellectual property laws. The Content is the property of the City or its respective owners, as indicated. The Website as a whole may be protected as a collective work and/or compilation. You do not acquire ownership rights to any Content by accessing or using the Website. You must comply with all additional notices, restrictions, and licence terms posted with the Content.
3. Limited Right to Use
Subject to these Terms, the City grants you a limited, non-exclusive, non-transferable licence to access, view, and use the Website for personal, non-commercial purposes. You may download, store, and print single copies of Content for personal, non-commercial use provided you maintain all copyright and other proprietary notices. This licence does not permit resale or commercial use of the Website or the Content, creation of derivative works, or the use of data mining, robots, or similar data-gathering or extraction tools.
Except as expressly allowed above, you may not modify, copy, reproduce, publish, distribute, transmit, display, perform, reverse engineer, decompile, disassemble, or otherwise exploit any part of the Website or Content without prior written consent from the City. Requests for permission may be directed to the City Clerk, City Hall, 50 Dickson Street, P.O. Box 669, Cambridge, ON N1R 5W8.
4. Editing, Deleting, and Modification
The City reserves the right, in its sole discretion and without notice, to edit, delete, suspend, or modify any documents, information, forms, services, or other Content appearing on the Website.
5. Prohibited Conduct
You agree not to introduce into or through the Website any information or material that may be harmful to others or that infringes the rights of any person or entity. Without limiting the generality of the foregoing, you shall not:
- interfere with or disrupt the Website or computer networks connected to the Website;
- impersonate any other person or entity or make any misrepresentation or defamatory or libellous statements;
- upload, post, transmit, publish, or distribute any material or information that contains a virus or other code, files, or programs intended to disrupt or interfere with the functioning of the Website;
- use the Website to gain unauthorized entry or access to the computer systems or networks of others, or attempt to access password-protected or restricted areas of the Website or the City's systems;
- violate any law or regulation or any generally accepted internet practice, or interfere with any other user's ability to use the Website;
- forge, alter, or modify in any way any agreements, policies, or other information posted or accessible on the Website;
- delete or revise any material posted by any other person or entity;
- manipulate or otherwise display the Website using framing or similar navigational technology.
6. Website Performance, Cookies, and Analytics
The City may log IP addresses for systems administration purposes and to determine how often different areas of the Website are visited and from what approximate geographic location the Website is accessed. IP addresses are not used to track individual sessions and are not linked to information that is personally identifiable.
The City may use cookies to track use of the Website and to facilitate and enhance your experience. Cookies are small files stored on your device by your browser. Cookies enable the City to understand how visitors use the Website (for example, which pages are visited) and may help remember certain preferences when you request information or services. Most web browsers automatically accept cookies, but you can disable this function; doing so may affect your experience on the Website.
The Website may use Google Analytics to collect information about your use of the Website. This information, which may include the web address of pages visited and your IP address, may be transmitted to and stored by Google, which may set or read cookies. The City uses aggregated analytics reports to help improve the Website's structure and content.
Google may also use this data in accordance with its Privacy Policy at http://www.google.com/policies/privacy/
The City may enable Google Analytics Demographics features, which use a third-party cookie to collect information about traffic to the Website across sites and over time, generating reports that help the City better understand Website users.
The City also uses AccessiBe’s AI-powered accessibility tools to help identify and address accessibility barriers on the Website and enhance its usability for individuals with disabilities. In the course of providing these services, information, such as IP addresses, may be collected.

7. Third-Party Sites
The Website may provide links to or from other third-party websites ("Other Sites"). The City does not operate or control the products, services, or content offered by Other Sites, does not endorse or approve them, and is not responsible for them. Linking to or using Other Sites is at your sole risk. All rules, policies (including privacy policies), and operating procedures of Other Sites apply to you while on those sites, and the City is not responsible for information provided on Other Sites.
8. Collection and Use of Personal Information
The Municipal Freedom of Information and Protection of Privacy Act (MFIPPA) applies to information collected by the City through the Website. Information will be collected, used, and disclosed only in accordance with MFIPPA. For more information, please refer to the City's Privacy Policy on the Website.
9. Online Payments
The City may offer online payment services through third‑party payment processors. The City does not collect or retain full credit card or debit card numbers. All payment transactions are processed and confirmed by the applicable third‑party payment processor and may be subject to additional terms and conditions imposed by that provider. The City is not responsible for any interruptions, errors, or issues arising from or related to third‑party payment systems.
10. Accessibility and Alternate Formats
The City is committed to providing accessible information in accordance with the Accessibility for Ontarians with Disabilities Act (AODA). Upon request, the City will provide any Website content, documents, or communications in an accessible or alternate format, or with communication supports, as required to meet your needs.

11. Indemnification
You agree to indemnify, defend, and hold harmless the City and its Mayor, Members of Council, officials, employees, agents, and representatives from and against any and all liability, loss, claims, and expenses (including reasonable legal fees) related to your violation of these Terms or your use of the Website.
12. Disclaimers
The Website and all Content are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, usefulness, completeness, accuracy, reliability, or availability. The City does not represent or warrant that the Website will meet your requirements, that access will be uninterrupted or error-free, that defects will be corrected, or that the Website is free of viruses or other harmful components. You are solely responsible for implementing safeguards to protect your systems and data, including appropriate backups and security measures.
13. Limitation of Liability
To the maximum extent permitted by law, in no event will the City be liable for any damages whatsoever, including without limitation indirect, special, incidental, consequential, exemplary, or punitive damages, or damages for loss of profits, business interruption, data loss, or other intangible losses, arising out of or in connection with your use of, or inability to use, the Website or any linked sites, even if the City has been advised of the possibility of such damages. Your sole and exclusive remedy is to stop using the Website.
14. Termination of Use
The City may, in its sole discretion and without notice, terminate, suspend, or refuse to permit your use of any services on the Website and/or your access to the Website, for any reason, including for any use contrary to these Terms or to law, or any use that disrupts the Website.
15. Governing Law and Jurisdiction
These Terms and the Website are governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of law principles. Any claims, disputes, or legal proceedings arising out of or in connection with the Website or these Terms shall be brought solely in the courts of the Province of Ontario, and you expressly submit to the exclusive jurisdiction of those courts.
16. Survival
The provisions of these Terms that by their nature should survive termination or expiry shall so survive, including without limitation ownership provisions, warranty disclaimers, limitations of liability, indemnities, and governing law.
17. General
These Terms constitute the entire agreement between you and the City regarding the use of the Website and supersede all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the Website. The City's failure to insist upon or enforce any provision of these Terms shall not be construed as a waiver of any provision or right. If any provision is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. To the extent that anything on or associated with the Website is in conflict or inconsistent with these Terms, these Terms shall take precedence.
